Can Chinese nationals own equity with foreign investors or companies in such enterprises?
At present, whether through a new establishment or an acquisition, Chinese nationals are not allowed to own equity in FIEs together with foreign companies, foreign enterprises, other foreign economic organizations or foreigner individuals. However, subject to the approval of MOFTEC, an exception may be made for Chinese nationals who have already been equity holders in an existing enterprise with less than 25% foreign investment, for over one year.
