Your lawyer or agent should be able, after full disclosure from you and discussions with you, to tell you whether or not your invention or creation is one that may be deserving and capable of patent protection. It is also recommended that a search be conducted to determine if other patents or literature already exists that may be pertinent to your invention/creation. Such searches help you to avoid being rejected in an application or to clarify those features of your idea or invention that are not presently found. Further, since a patent may be challenged later in the Intellectual Property Office on the basis of lack of inventiveness, it is important to search and review all pertinent material.
