Can I file a patent for software?

According to the Chinese Patent Law, no patent rights shall be granted for the methods of intellectual activities. According to the Regulations of the Chinese Patent Law, invention means any new technical solution relating to a product, a process or improvement thereof. Therefore, only those computer programs that provide a new, technical resolution can apply for a patent application. Ordinarily, computer software is not protected by patent law in China.
