What law makes grey-market goods illegal in the United States?
(a): Section 526 of the Tariff Act of 1930, 19 U.S.C. 1526, was intended to provide protections against grey market goods. Due to ambiguities in practice, §526 has not been interpreted to provide for a total ban on grey market goods, and companies are frequently unable to exclude such goods purely on trademark grounds. Companies have stronger arguments in the case of copyrighted materials, and almost categorical protection for patented goods.
