What happens in a WTO member believes another member has not satisfied the requirements of TRIPS?
If a dispute arises concerning a nation’s compliance with its TRIPS obligations, it is possible for the complaining nation to seek dispute settlement under the WTO Understanding on Dispute Settlement. At the preliminary stages of the dispute settlement process, the parties have opportunities for the informal settlement of the dispute through consultations and mediations. If the informal process does not work, the parties then undergo a process much like that of civil litigation.
