What common features do bilateral investment treaties provide?
(a): Most all BITs allow for admission into the host country and prohibit expropriations of investment property. Most will provide for nondiscriminatory treatment of foreign investors and prohibit requirements of specific performance levels. Most BITs require the host nations to give protection and security to the investor’s property from military operations and acts of terrorism. BITs will generally provide for settlement of disputes, often pursuant to the ICSID Convention.
