How is choice of law made for an international contract?
(a): The court in the forum state will apply the choice of law rules of the forum state, absent an agreement in contract. This gives rise to a great deal of unpredictability when the parties do not spell out the choice of law they wish to apply. The CISG alleviates some of this, as a vast majority of nations now have a uniform set of laws dealing with the international sale of goods.
