How does the U.S. Alien Tort Statute apply to private entities?
(a): Until recently, it did not. However, 2004 the Supreme Court decided Sosa v. Alvarez-Machain opened up private entity liability for violation of “norms of customary international law,” a concept which has not yet been specifically interpreted. This could potentially open up many new kinds of liability to companies acting internationally, so long as they violate commonly adopted customs or practices among many nations.
