How do courts resolve conflict of law issues between differing national laws in an international case?
(a): Courts examine a myriad of factors in determining which law to apply in an international case. Courts will look at the locations where the relevant events occurred and examine relevant policies from both countries to see whether each would be impaired by application of the others’ law. Parties are free to contract for choice of law in their agreements, and doing so will preclude a good deal of ambiguity.
