Do the US and the EU take the same approach to M&A?
No, EU laws assume anti-competitive effects will arise out of a concentration, while U.S. authorities believe that competition will be maintained if there are no substantial barriers to market entry. Further, in the US the FTC and the Justice Department have no power to block a merger, they must ask for an injunction in Federal Court.
