What are the requirements for lodging a prosecution in court?
According to Article 108 of the Civil Procedural Law of PRC, a prosecution must conforms to the following requirements:
1. The prosecutor should be the citizen, legal person and other organizations which have a direct interest and relationship in the said case;
2. There should be a specific defendant in the prosecution;
3. There should be a concrete claim, facts and reasons in the prosecution;
4. The prosecution shall fall into the scope of civil lawsuits accepted by court, and is ruled by the People's Court that accepts the case.
